Terms and Conditions

  1. All Complaints will be fully investigated and meaningful feedback given to the complainant.
  2. The owner/s of Diabolique Online store can repair the faulty product or if it is not possible, you can:
    1. Receive a refund in your bank account (exception: shopping done by redeeming a voucher)
    2. Exchange the product for the same kind – if it’s available on Diabolique Online
    3. Exchange for a different product – in this case, a potential surplus will be refund, or in case of choosing more expensive product you can pay the difference.
  3. The owners of Diabolique Online store stipulate the right to:
    1. Change the prices and amounts of sizes offered
    2. Withdraw products from special offer
    3. Organize any kind of sales, special offers and advertising campaigns
    4. Changes in the Terms and Conditions become effective on a day indicated by the owner/s of Diabolique Online store. Orders placed by Customers before the changes in the Terms and Conditions are fulfilled.
  4. All personal data is protected.

General Terms and Conditions

  1. These Terms and Conditions govern the supply by us of any Product ordered by you on www.diabolique-online.co.za.
  2. The mentioned above online shop is owned by Diabolique Entertainment, a company organized and existing under the laws of the Republic of South Africa.
  3. Customer Service is available for you from Monday to Friday (10am – 3pm) and can be reached either by calling: +27 (0)71 367 7820 or via e-mail: sales@diabolique.co.za
  4. By placing an order, you agree to the Terms and Conditions and accept them.
  5. The proof of sales contract is a receipt or invoice in electronic or paper form.
  6. By posting opinions, photos or any kind of materials on the Diabolique Online website you warrant that you own the copyright. At the same time, you are giving the owner/s of Diabolique Online the right to use these materials on the different websites, especially: blog, Facebook, Instagram account, Pinterest account and any other kind of communication held via newsletters without any (time or territorial) limitations.
  7. All products offered by Diabolique Online are free from law restrictions and have been legally entered for sale. They are also free from defects and faults (except products offered within 2nd Quality category).
  8. All Products offered within the 2nd Quality category are sold at a lower (than a regular) price.

Terms and Conditions of Online Shopping

  1. The Purchase Agreement is concluded between the owner of Diabolique Online and the Customer who is placing an order.
  2. Prices given on the website are gross-prices (it means they include Value Added Tax). Prices given at the moment of placing an order are binding for both parties. The prices also include PostNet to PostNet shipping anywhere in South Africa. Any other form of shipping will be calculated separately and presented to you before confirmation of your order.
  3. An order can be placed 24 hours a day, 7 days a week, except for technical breaks.
  4. The conditions of placing an order are: completing the form with correct, mandatory data required for shipping and for a sales document (receipt or invoice). Given information must be real and valid or your shipment could be compromised.
  5. You are allowed to modify your order until the final confirmation of it.
  6. After the order confirmation an order summary will be e-mailed to you.
  7. Diabolique Online will confirm the Customer’s purchase by sending an order confirmation e-mail. Order confirmation is a declaration of the acceptance of an offer. Order confirmation should be understood as an agreement for Order fulfilment between the Customer and Diabolique Online. Diabolique Online has 5 days to confirm the order from the moment of receiving the order. If there is no confirmation within the term stated above, there is no Contract and the payment made by the Customer will be returned as soon as possible.
  8. The owner/s of Diabolique Online has/have the right to refuse fulfilling the order in case of giving fraudulent or invalid data; or when the transaction has not been authorized in the electronical payment system or the payment has not been received within the fixed term (5 business days).

Discount codes, vouchers, special offers

  1. Any special offers cannot be combined with other special offers or discounts. You may only use an offer once, and you may not combine the offer with any other discount at the same time.
  2. Any kind of special offers do not refer to the 2nd Quality products unless its specific terms and conditions allow it.
  3. Every discount code is unique and can be used only once unless its specific terms and conditions allow multiple usage.
  4. Vouchers can be redeemed within all categories available on Diabolique Online unless its specific terms and conditions determine a particular category.
  5. Vouchers should be redeemed within one order (including the shipping costs, unless the specific terms states differently). In case of not using all of the voucher’s amount the outstanding amount is forfeited and is not exchangeable for cash.
  6. If the value of the order exceeds the amount available within the voucher, you can pay the difference in any method of payment available at Diabolique Online. Neither vouchers nor discounts codes can be used for third party orders.

Payment

  1. The owner/s of Diabolique Online has/have the right to refuse to fulfil the Order if:
    1. There is an incorrect/incomplete fulfilment of the Order form (lack of data required for Order fulfilment)
    2. Payment has not been made by the Customer within 14 business days from the moment of placing the Order
    3. The owner of Diabolique Online will inform the Customer about refusing to fulfil the Order by sending an e-mail (to e-mail address given by the Customer during placing an Order)
    4. The owner/s of Diabolique Online accepts the following methods of payment:
      1. Bank transfer (banking details will be provided on invoice)
      2. Credit cards
      3. Online payment

Shipment

  1. Orders will be shipped on the next business day after payment is reflected in Diabolique’s bank account. In case of orders placed on holiday, they will be fulfilled on the next business day after receiving the payment. In case of credit card payment, the delivery date is calculated from the moment of positive transaction authorization.
  2. Ordered Products will be sent under the shipping address given by you in the form.
  3. Should an order be undeliverable, the cost of returning the parcel shall be obliged to pay for this cost.

Final Terms

  1. The owner/s of Diabolique Online reserve the right to:
    1. Change the prices and amounts of sizes offered
    2. Withdraw products from the offer
    3. Organize any kind of sales, special offers and advertising campaigns.
    4. Changes in the Terms and Conditions become effective on a day indicated by the owner/s of Diabolique Online. The amended Terms and Conditions must be available at Diabolique Online for at least 7 days before they become effective. Orders placed by Customers before the changes in the Terms and Conditions are fulfilled in accordance with Regulations effective at that time.
    5. Any matters between you and the owner/s of Diabolique Online should be solved by the appropriate court according to the provisions of South Africa law. However, you should be informed that there are multiple different ways of solving complaints or other matters, such as: arbitration, mediation and/or conciliatory. Mentioned above ways are governed by adequately by South Africa law and restrictions.
      These Regulations come into force from the date of 1 May 2021.
